Foreign Land Ownership Regulations for BOI-Promoted Companies is Revised in Thailand泰國修訂獲得BOI激勵公司之外國人土地所有權法規

The Board of Investment in Thailand (“BOI”) has amend the criteria for BOI-promoted companies to own land for residential use and introduced new procedures for land ownership applications under new notification. On 6 January 2026, “Notification of the Office of the Board of Investment No. Por. 9/2568 Re: Amended Criteria and Conditions for Permitting Foreign Juristic Persons Receiving Investment Promotion to Own Land for Office and Residence for Operational-Level Workers to Operate Business Granted Investment Promotion”[1] dated 18 July 2025, was published in the Government Gazette, and is applicable to all applications submitted since the date of the notification which is 18 July 2025.
泰國投資委員會(“BOI”)已修訂獲得 BOI 激勵之公司持有住宅用地的標準,並根據新公告導入土地所有權申請的新程序。「泰國投資委員會辦公室公告第 Por. 9/2568 號:關於修訂獲准投資獎勵之外國法人持有辦公室及營運層級員工宿舍用地之標準與條件」日期為2025年7月18日,於2026 年 1 月 6 日公告於政府公報,且適用於自公告日期,即 2025 年 7 月 18 日起提交的所有申請案。
Online application process for BOI-promoted companies seeking to own land for office use or residential purposes via the e-Land system, the BOI’s electronic system for land rights and benefits is introduced by the new notification. Applications are reviewed virtually, and any requested amendments or additional documents must be submitted within 7 business days. Failure to amend the application or submit any additional requested documents within this period will result in automatic rejection and removal of the application from the system. The BOI issues final approval or denial as a hard-copy letter sent by postal mail.
這項新公告導入一項線上申請程序,供獲得 BOI激勵之公司透過 e-Land 系統,BOI 的土地權利與優惠電子系統,申請持有辦公室或住宅用途之土地。申請案將進行虛擬審查,且任何要求的修改或額外文件必須在 7 個工作日內提交。若未能在該期限內修改申請案或提交任何要求的額外文件,將導致申請案被自動駁回並從系統移除。BOI 將以郵寄方式寄送紙本信函發布最終的核准或拒絕通知。

Ø Housing Definitions & Limits: Worker housing must be purpose-built buildings exclusively for operational-level workers, sized proportionally to the workforce. It must not be part of land-subdivision projects, condo units, detached houses, or shophouses. In addition, if off-site, must lie within 10 km along main public roads of the primary project.
住房定義與限制:員工住房必須是專門為營運層級員工建造的專用建築,且面積須與員工數量成比例。其不得為土地分割開發計畫、公寓大樓單位、獨立別墅或店屋的一部分。此外,若位於計畫地點外,必須位於主計畫案主要公共道路沿線10公里範圍內。
Ø Company-wide limits apply: 5 rai for offices; 20 rai for worker housing (operational level).
公司整體限額:辦公室限額為 5 萊;營運層級員工住房限額為 20 萊。
Ø Elimination of Executive Residences: The previous allowance for BOI-promoted companies to hold up to 10 rai of land for executive or expert housing has been removed. BOI land ownership rights now cover only office premises and housing for operational-level employees.
取消高階主管住所:先前允許獲得 BOI 激勵公司持有最多 10 萊土地作為高階主管或專家住房的規定已被移除。BOI 土地所有權現在僅涵蓋辦公場所及營運層級員工之住房。
Ø Compliance, Inspection & Disposal: BOI may inspect land use and access premises at any time. The land must be used strictly in accordance with the purposes approved by the BOI and must not be used for any other purposes contrary to public morals or applicable laws. Non-compliance triggers revocation of land rights; the land must be sold within one year of the revocation notice.
合規、檢查與處分:BOI 可隨時檢查土地使用情況並進入場所。該土地之使用必須嚴格遵守BOI 核准之用途,且不得用於任何違反公共秩序、善良風俗或相關法令之其他用途。不合規將導致土地權利被撤銷;土地必須在撤銷通知發出後的一年內出售。
The revised BOI regulations on land ownership help reduce legal restrictions and enhance regulatory clarity, enabling investors to plan and expand their businesses more efficiently. In particular, the rules support the establishment of office premises and housing for operational-level workers, which helps improve employees’ quality of life, encourages sustained employment, and promotes long-term, sustainable business development.
BOI關於土地所有權的修訂法規,有助於減少法律限制並提升法規透明度,使投資人能更有效地規劃及擴張業務。特別是這些規定支持設立辦公場所及基層員工宿舍,這不僅有助於改善員工生活品質、鼓勵穩定就業,更能促進企業的長期永續發展。
